If a product offered by Liv Evon Designs LLC is not as described, your sole remedy is to contact us to seek an exchange or return of the item in unused condition.

Liv Evon Designs shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Liv Evon Designs has been advised of the possibility of such damages. 5. Typographical Errors
In the event that a Liv Evon Designs product is mistakenly listed at an incorrect price, Liv Evon Designs reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Liv Evon Designs reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Liv Evon Designs shall issue a credit to your credit card account or online payment method used in the amount of the incorrect price.
6. Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Liv Evon Designs without notice at any time, for any reason. Therefore, you should review these page periodically. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification, Miscellaneous, Return and Refunds, Site Communities, Third Party Links shall survive any termination.

You agree to receive from time to time promotional messages and materials from Liv Evon Designs, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

9. Miscellaneous
Your use of this site shall be governed in all respects by the laws of Virginia, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Liv Evon Designs products or programs) shall be in the state or federal courts located in Virginia. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Liv Evon Designs products or participation in programs) must be commenced within one (1) year after the claim or cause of action arises. Otherwise, such cause of action is permanently barred. Liv Evon Designs failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Liv Evon Designs may assign its rights and duties under this Agreement to any party at any time without notice to you.

10. Return and Refund Policy
​
Due to hygienic purposes, we do not accept returns. If an item is defective, you can contact us (info@livevondesigns.com) within 3 days of the item being delivered for an exchange for the exact same item or store credit. Shipping costs will be covered for damaged items that are returned for store credit and for both items involved in an exchange - this applies to US orders only. Unfortunately, at this time shipping costs for non-U.S. orders cannot be covered.

Cancellation Policy
Orders for non-custom or non-personalized work in any capacity may be cancelled anytime prior to the order being marked as shipped. Once the order is shipped, cancellations cannot be made and the items will be billed and shipped to the address listed on the order. If an item is marked for pick-up at a location that is agreed upon between the customer and Liv Evon Designs, the item can be cancelled at any prior to the day of drop off. If the item is not picked-up by the customer, no refund will be given for no-shows or day-of order cancellations.

11. Use of Site & Site User Communities

Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including Liv Evon Designs or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization. The Site is intended for use by individuals 13 years of age or older. If you are under 18, you may use this Site only with involvement of a parent or guardian.

Site User Communities

All users that join a community by way of signing up for a site member account have a public profile that is publicly visible to site visitors, your public activity (such as posts or comments) will be visible to other visitors of the website. A user of the website can always opt-out and exit the community, and upon doing so, such user’s profile will not be publicly visible. Naturally, in such event the user will not be able to use the community features (e.g. liking, commenting, writing posts, or access to the Loyalty Rewards Points Program).

Right to suspend or cancel user account

Liv Evon Designs may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

Participation Disclaimer
Liv Evon Designs does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Liv Evon Designs is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Liv Evon Designs reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to Liv Evon Designs in its sole discretion.

Indemnification
You agree to indemnify, defend, and hold harmless Liv Evon Designs, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

In an attempt to provide increased value to our visitors, Liv Evon Designs may link to sites operated by third parties. However, even if the third party is affiliated with Liv Evon Designs, Liv Evon Designs has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Liv Evon Designs. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Liv Evon Designs seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

12. Loyalty Rewards Program
I. Membership & Eligibility
​
The Loyalty Rewards Program (from here on referred to as, “Program") is a free rewards program offered by Liv Evon Designs LLC. Membership in the Program (from here on referred to as, "Membership") is limited to individuals only and is limited to one account per individual. You must be age 13 years or older and a legal resident of the United States or Canada to be eligible for Membership. Eligible minors confirm they have obtained their parent's or legal guardian's consent prior to participation.
BY APPLYING FOR MEMBERSHIP IN THE PROGRAM, YOU AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN HAS AGREED) TO BE BOUND BY THESE TERMS AND CONDITIONS ("TERMS"). NO PURCHASE IS NECESSARY TO BECOME A LOYALTY REWARDS MEMBER.
II. Earning and Redeeming Collectors Points

Membership provides a variety of benefits made available by Liv Evon Designs in its sole discretion from time to time (from here on referred to as, “Benefits”). The type, timing and availability of any Benefits (including but not limited to Rewards (as defined below), special offers, one of a kind experiences, exclusive events and advance access to products) will be determined by Liv Evon Designs in its sole discretion. Liv Evon Designs may, in its sole discretion, alter, limit, or modify the rules, regulations, benefits, eligibility for membership, or any other feature of membership or may terminate features of membership at any time in its sole discretion, without prior notice except as expressly set out in these Terms or required by applicable law.

Collectors Points
​
Under the Program, membership will have 1 Collectors point credited to their membership account for every U.S. dollar spent on fulfilled orders of merchandise (as applicable based on country of purchase) (a “Collectors Point”).
We may offer bonus points events from time to time and in that circumstance the bonus points offer would apply. Separate terms and conditions will apply to each bonus points offer.
You must provide your Collectors Points registered e-mail address and/or phone number to have any Collectors Points credited to your account. Collectors Points previously credited to your account will be removed if the order that resulted in such points is cancelled.
Any reference to "merchandise" or the value of merchandise in these Terms for purposes of collecting Collectors Points includes all Liv Evon Designs products sold online only at LivEvonDesigns.com. It does not include payment for shipping.
As part of the Benefits of being a member, your Collectors Points may be redeemed for rewards made available by Liv Evon Designs from time to time in its sole discretion (“Rewards”). You are eligible to redeem Collectors Points for a Reward if you have enough Collectors Points in your account for that specific Reward. Rewards can only be redeemed online. Collectors Points themselves have no cash value and can only be redeemed for Rewards. Liv Evon Designs may, in its sole discretion, allow Collectors Points to be redeemed for other benefits or items of merchandise from time to time. However, unless expressly permitted by Liv Evon Designs, Collectors Points are never redeemable for cash or for another products.

Collectors Point Expiration
​
All unredeemed Collectors Points will expire when a program member has not engaged in rewards program activity associated with the membership account (through purchase or redemption) for 24 months or more. If you have questions regarding the date of your last Collectors Point activity or your last purchase, check your account page. If you feel Collectors Points have been expired in error, please email us at info@livevondesigns.com for assistance.
In addition, Collectors Points will automatically expire if your Membership is revoked or otherwise cancelled for the reasons further detailed in Section 7.

Site Member Account/Loyalty Rewards Program Profile

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Wix.com also hosts the site member account pages, which houses your loyalty rewards program profile. This profile is your destination for everything Loyalty Rewards Program related, including the Benefits associated with your membership; your current Collectors Point balance or Collectors Point activity. Your site member account and Loyalty Rewards Program profile can be accessed by logging into your online account at www.livevondesigns.com.
III. Rewards

Generally

Liv Evon Designs offers Rewards, in its sole discretion, that are listed on the Loyalty Rewards Program page and/or in the Loyalty Rewards Program profile in the site member account. Rewards can be redeemed using Collectors Points for Rewards at checkout. Redemption usually starting around 60 Collectors Points. Rewards may vary but are typically discounts, free shipping, or free items. When shopping online, you can apply Rewards at online checkout, if you are logged into your site member account.
Some Rewards are for a limited time, while supplies last, and provided on a first-come, first-served basis. You must be a registered Loyalty Rewards Program member/account holder in order to redeem Rewards. Loyalty Rewards Points Program members may only redeem one of each Reward per transaction and only able to apply one reward at checkout. Collectors Points will be deducted at time of redemption. Rewards are subject to change, alteration, substitution, or termination by Liv Evon Designs in its sole discretion at any time.
All Rewards are non-transferable, have no cash value (unless required by law) and cannot be sold, returned or exchanged for Collectors Points, cash, another product, gift card or e-gift certificate unless pursuant to a specific offer from Liv Evon Designs. Liv Evon Designs is not responsible for lost, stolen or damaged Rewards. You are solely responsible for any taxes incurred by you relating to the receipt of Rewards. Some Rewards may only be available to a resident of the U.S.. Employees or contractors working with Liv Evon Designs who have employee discounts that apply to purchases they make, may only receive Collectors Points for the portion of the purchase they paid for with money – money saved from discounts applied to their purchase does not count as rewards point that can be received and added into your Loyalty Rewards Program profile via your site membership account. Please contact Liv Evon Designs via email at info@livevondesigns.com for any help with redeeming Rewards.

Online Order Cancellation
​
If you cancel an item or all items from your order, redeemed Collectors Points will be re-credited if an order is cancelled by Liv Evon Designs.
IIII. Benefits and Rewards Explained

Percent off 1 Item Reward
​
Loyalty Rewards Point members who meet the needed Collectors Points can redeem their points for percent off (example: 10%, 20%, 50%) of 1 item in their order. If multiple items are being ordered, 10% goes towards the lowest priced item. To collect the reward, sign into your site member account and select this reward in your Loyalty Reward Point profile to redeem and apply it to your chosen order.
Percent off rewards cannot be applied to certain collections, such as the Formal Collection.

Standard Free Shipping Reward
​
Free shipping rewards are available for Loyalty Rewards members who have enough Collectors Points to redeem this reward. This reward is only applicable for standard shipping, not expedited, in the U.S. To collect the reward, sign into your site member account and select this reward in your Loyalty Reward Point profile to redeem and apply it to your chosen order.

V. Agreeing to Liv Evon Designs’ Privacy Policy & Email
​
BY SIGNING UP FOR MEMBERSHIP IN THE LOYALTY REWARDS POINTS PROGRAM, YOU AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN AGREES) TO BE BOUND BY LIV EVON DESIGNS APPLICABLE PRIVACY POLICY (FOUND HERE) AND OUR WEBSITE TERMS OF USE (FOUND HERE).

VI. Communications with Liv Evon Designs; How to Opt Out
​
By signing up for Membership in the Program, you agree (or, if you are a minor, your parent or legal guardian agrees) to receive advertising, marketing materials and other communications from Liv Evon Designs. By signing up to join the Program, you will automatically be subscribed to receive Program emails.

If you do not wish to receive these communications, you can request that they be discontinued by reaching out to us at info@livevondesigns.com.

VII. Changes, Termination and/or Removal From Program, Account Closure
​
Program Changes: Liv Evon Designs may, in its sole discretion, alter, limit, or modify the Program rules, regulations, benefits, Rewards, eligibility for Membership, or any other feature of the Program (including assigning any of its obligations to customers under the Program at any time to another person or entity, without recourse) or may terminate the Program any time at its sole discretion, by posting any such changes on the Liv Evon Designs website.

YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING SUCH CHANGES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES.

Termination or Removal from Program: Liv Evon Designs reserves the right to exclude individuals from the Program, remove Collectors Points from a member’s Loyalty Rewards Points profile and/or cancel orders that are not consistent with Liv Evon Designs’ policy in its sole but reasonable discretion. In particular, any abuse, manipulation or "gaming" of the Program or its rules (as determined by Liv Evon Designs) including multiple redemptions of Rewards by the same individual via different accounts, failure to follow any terms of the Program, Membership inactivity for more than 24 months, reselling Rewards, any misrepresentation or any conduct detrimental to the interests of Liv Evon Designs not otherwise protected by law may subject members to Membership revocation or deduction of Collectors Points obtained through these abusive or manipulative activities, cancellation of orders and will affect eligibility for further participation in the Program. Membership is non-transferable and Membership purchases must be made by the member. If your Membership is revoked or otherwise cancelled, any Collectors Points in your account will automatically expire. Liv Evon Designs reserves the right to make changes to its Website and these Terms at any time. It is your responsibility to check or review these Terms from time to time to keep informed of any changes. By joining the Program, you hereby agree to be bound by any such changed Terms.

Account Closure: If you chose to close your membership account, you can do so by contacting Liv Evon Designs at info@livevondesigns.com or via self-closure. Loyalty Rewards Points Program accounts that are closed can be re-opened upon request by contacting Liv Evon Designs at the email previously provided. If you close your Loyalty Rewards Points Program profile/account and your site member account, you must agree to the terms of closure:

You will no longer be able to log into your account.

You will forfeit all of your existing Collectors Points, status, and benefits.

You will no longer accrue Collectors Points on purchases.

You will be opted out of all Liv Evon Designs Loyalty Rewards Points Program marketing, including emails, SMS, and push notifications.

Closing your Loyalty Rewards Points Program account will not affect open orders, returns, and Paid Service appointments.

VIII. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LIV EVON DESIGNS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANYKIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS ACOMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUTNOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENTPERMITTED BY LAW, THE LIMITATIONS ON LIV EVON DESIGNS’ LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OFNEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN WILLINGLY AGREES) THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM LIV EVON DESIGNS AND THAT THIS IS A REASONABLE ALLOCATION OF RISK. THIS PROVISION DOES NOT APPLY TO NEW JERSEY RESIDENTS.

All Program design, text, graphics, logos, button icons, images, audio clips, the selection and arrangement thereof, and all proprietary software is Copyright (c) 2020-2023 Liv Evon Designs LLC, ALL RIGHTS RESERVED. The compilation (meaning the collection, arrangement and assembly) of all Program content is the exclusive property of Liv Evon Designs and protected by U.S. and international copyright laws. All software used in connection with the Program is the property of either Wix.com or Liv Evon Designs or other software suppliers and is protected by U.S. and international copyright laws. Unless otherwise indicated one part of the Program materials, permission is granted to electronically copy and to print in hard copy portions of the Program materials for the sole purpose of accessing the Program and the services provided therein for personal use. Any other use of Program materials - including reproduction, modification, distribution, republishing, transmission, displayer performance - without the prior written permission of Liv Evon Designs is strictly prohibited.

X. Resolving Disputes
​
If a dispute should arise between you and Liv Evon Designs, we want to provide you with a resolution that is efficient and cost effective. Almost all customer service disputes can be resolved by emailing info@livevondesigns.com.

If your dispute cannot be resolved via email only, the Terms describe in section 9 indicates how we shall proceed with the resolution of the dispute.
TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND LIV EVON DESIGNS AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE PROGRAM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

XI. Severability
​
The provisions of this Program are intended to be interpreted in a manner which makes them valid, legal, and enforceable. In the event any provision is found to be partially or wholly invalid, illegal or unenforceable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. It is expressly understood and agreed between the parties that such modification or restriction may be accomplished unilaterally by Liv Evon Designs, or alternatively, by disposition of an arbitrator or a court of law. If such provisions cannot under any circumstances be so modified or restricted, they shall be excised from the Program Terms without affecting the validity, legality or enforceability of any of the remaining provisions.
